Terms & Conditions
Who am I?
We are Sound School Limited, the provider of music tutoring which are referred to in these terms as the “Services”.
Who is our contract between?
Whilst the Services are provided to children, the contract for those Services is between you and us.
How long are you in the contract for?
The contract for the Services will start when you agree to these terms and conditions, but you can end it at any time by emailing us at susanna@soundheroes.co.uk. Your contract will end 28 days after we receive your email.
What if my child(ren) can’t attend a session?
There is no need to notify us if a child cannot attend as payment is made on a monthly subscription basis and not on a session-by-session basis. No refunds will be given if a child cannot attend a session.
Attending my sessions
Please ensure that your child(ren) behave in a way that does not disrupt any session and/or does not threaten, upset or abuse our staff or any other child. If any child does not behave in this way, they will be excluded from the session and, if we decide appropriate, future sessions. No refund of any changes will be paid in these circumstances.
We reserve the right to shut off a session 5 minutes after the start time so your Child(ren) may not be admitted after that point.
How does payment work?
We take all payments by debit or credit card via a third party payment provider.
We charge interest on late payments
If we are unable to collect any payment you owe us, we charge interest on the overdue amount at the rate of 4% a year above the Bank of England base rate from time to time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You pay us the interest together with any overdue amount.
Our charges may increase and we pass on increases in VAT
If we intend to increase our charges, we will give you no less than 28 days’ notice by email
If we charge VAT and the rate of VAT changes at any time, we will adjust the rate of VAT that you pay.
We are not responsible for things outside of my control
If our supply of the Services is delayed or prevented by an event outside our control, such as illness or unavailability of any venue, we will (where possible) contact you as soon as possible to let you know. As long as we do this, we won’t compensate you for the delay or failure to deliver the Services.
Your legal right to change your mind.
You can change your mind and cancel our contract up fourteen days from the date you signed up or the point that your child(ren) attend their first session (whichever comes sooner). After that, please see the “How long are you in the contract for?” section above if you want to cancel your contract.
How to let us know. To let us know you want to change your mind email me at susanna@soundheroes.co.uk.
We can end our contract with you
We can end our contract and claim any compensation due to me (including enforcement costs) if:
- you don’t make any payment to us when it’s due and you still don’t make payment within 7 days of us reminding you that payment is due;
- you or your child(ren) are particularly or consistently disruptive, rude, aggressive or violent;
- we no longer provide the Services;
We can also end our contract with you by giving you no less than 28 days’ notice at any time.
We don’t compensate you for all losses
We are responsible for losses you suffer caused by us breaking this contract unless the loss is:
- Unexpected. It was not obvious that it would happen and nothing you said to us meant we should have expected it (so, in the law, the loss was unforeseeable).
- Caused by a delaying event outside our control. As long as we have taken the steps set out in the section “I’m not responsible for delays outside my control”.
- Avoidable. Something you could have avoided by taking reasonable action.
We use your personal data as set out in my Privacy Notice
How we use any personal data you give us is set out in our Privacy Notice: [LINK TO PRIVACY NOTICE].
Rights in our materials
As part of the Services, we will provide you and/or your Child(ren) with materials including resource and activity books and worksheets. These materials are our intellectual property and we retain all rights in them. They are not to be used for any purpose other than receipt of the Services and must not be copied or shared with anyone.
Photo Consents
From time to time, we may ask photographers to take pictures of sessions and/or concerts or other events. If you do not want your child(ren) to be photographed, please let us know in advance.
Other important terms apply to our contract
We can transfer our contract with you. We will tell you in writing if this happens and will ensure that the transfer won’t affect your rights under the contract.
You can only transfer your contract with us to someone else if we agree to this. We may not agree if that person does not agree to pay our fees by direct debit.
Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.
If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.
Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you’re not allowed to, but that doesn’t mean we can’t do it later.
Your statutory rights are not affected. To find out more about your rights visit https://www.citizensadvice.org.uk/
